Replevy and Other Legal Action

Not every client is amenable to resolving debts willingly. Sometimes it is necessary to take the debtor to court to force their hand. While we employ litigation as a last resort, Mr. Gannett is a skilled and accomplished trial lawyer, with several reported cases to his credit.

We may initiate replevin to gain legal possession of goods, either in lieu of payment or as impetus for settlement negotiations. The court will allow replevin, or to take possession of, the collateral (for example, leased manufacturing equipment) and determine whether to return them to the petitioning creditor.

We also initiate actions in court against transferees concerning the fraudulent conveyance of assets in order to avoid repayment of debts.
